Terms of Use

1. Who we are and what these terms cover

These Terms of Use govern your use of the service ("Service") provided by [Şirket Ltd. Şti.] ("Kervan", "we") through kervan.com.tr, the console and the API at api-kervan.poly1.fun. By creating an account and accepting these terms at signup, you agree to them.

If you buy balance as a consumer, the Distance Sales Agreement and the Refund and Withdrawal Policy also apply. How we process personal data is explained in the KVKK Privacy Notice, the Privacy Policy and the Cookie Policy.

2. The Service

Kervan is a prepaid intermediary service that gives you access to third-party AI models such as Claude and GPT through a single API. You top up in Turkish lira; your balance is held in US dollars, and each request is deducted from it at the model prices shown on the pricing page.

Kervan is independent. We are not partners or representatives of Anthropic, OpenAI or any other model provider. Model names and trademarks belong to their owners.

Available models, their features and prices may change. We make reasonable efforts to keep the Service running, but outages at model providers or in our infrastructure can happen. Current status is published on the status page. Failed requests are not billed.

3. Your account

• You must be at least 18 and legally able to enter into a contract.
• You are responsible for keeping the information you give us (email, country of residence, invoice details) accurate and up to date.
• Each person can receive the trial credit on one account only. You may not open multiple accounts to collect trial credit or bonuses.
• You are responsible for keeping your password and API keys secret. If you suspect unauthorized access, turn off the affected key right away and tell us.
• Requests made with your API keys are charged to your account. You can limit your risk by setting a spending limit and IP restriction for each key.

4. Regional restrictions and sanctions compliance

• The Service is not offered in Iran and is not available to people whose habitual residence is in Iran. Access from Iranian IP addresses is blocked.
• At signup you declare that you do not reside in Iran. If this is untrue, or becomes untrue later, you must tell us; otherwise we may suspend or close your account.
• You may not use the Service from Iran, or on behalf of or for the benefit of people or organizations in Iran, and you may not give them your API key, your balance or output from the Service.
• People and organizations on sanctions lists issued by the United Nations, the Republic of Türkiye, the European Union, the United States (OFAC) or the United Kingdom, or owned or controlled by them, may not use the Service, and the Service may not be used on their behalf or for their benefit.
• Trying to access the Service in breach of these restrictions using tools that hide your location (VPN, proxy and the like) will lead to suspension and closure of your account.
• To enforce these rules we use signals such as IP location and browser time zone, and we may ask for additional verification.
• Where an account is found to breach sanctions rules, any balance is refunded only to the extent and in the way the applicable law allows; if the law prevents it, the refund is put on hold.

5. Balance, prices and payment

• You top up in Turkish lira. 20% VAT (KDV) is added to the top-up amount; your balance is credited with the amount excluding VAT. The minimum top-up is ₺100.
• The lira amount is converted to US dollars at the Central Bank of the Republic of Türkiye (TCMB) USD selling rate at the moment you create the top-up order, and that rate is locked for that top-up.
• Today you pay by bank transfer (havale/EFT); card payments will be added later. The transfer must come from an account in your own name and include the reference code shown on the order screen. Orders not paid in time are cancelled automatically.
• Your balance is credited once the payment reaches our account and is matched to the order. We issue e-Arşiv invoices to individuals and e-invoices to companies registered for e-invoicing.
• Balance is spent in this order: trial credit first, then bonus credit, then purchased balance.
• Model prices are published on the pricing page. A price change only affects requests made after it takes effect; we announce price increases on the site at least [7] days in advance.
• Purchased balance does not expire. Unused purchased balance is refundable with no time limit under the Refund and Withdrawal Policy.

6. Trial credit and bonuses

• Trial credit: eligible accounts that verify their email and complete the residence declaration receive a one-time trial credit worth ₺50 in US dollars (at the rate on the day it is added). It is given once per person; disposable email addresses are not eligible, and claims from the same network may be limited.
• While on trial credit, only trial models are available; all models unlock with your first top-up.
• First top-up bonus: on your first top-up within 72 hours of signing up, top-ups of at least ₺250 receive a bonus of 20% of the amount excluding VAT, up to ₺1,000.
• Volume bonus: a single top-up receives a bonus based on the amount excluding VAT: ₺1,000 or more: 5%, ₺2,500 or more: 8%, ₺5,000 or more: 10%. The first top-up bonus and the volume bonus can be combined.
• Trial credit, bonuses and referral credit are promotional: they have no cash value, cannot be transferred and are not refundable. If a top-up is refunded, the bonus given with it is deducted from your balance.
• If we detect abuse (multiple accounts, false information and the like), we may take back promotional credit.

7. Acceptable use

When using the Service you may not:

• Generate content or take actions that break the law or the usage policies of the relevant model provider (for example child sexual abuse material, malware development, fraud, or content that infringes other people's rights).
• Attack the Service, our infrastructure or other users, try to get around security measures or billing, or use the Service in a way that overloads it.
• Sell, rent or share access to the Service or your API keys with third parties without our written permission.
• Break the regional restrictions and sanctions rules in section 4.

8. Content and intellectual property

• To the extent the law and the model providers' terms allow, the rights in the requests you send and the responses you receive belong to you.
• We do not store request or response content; we keep only usage metadata (see the Privacy Policy). Your requests are passed to the relevant model provider to generate the response.
• AI output can be wrong, incomplete or out of date. You are responsible for checking it before use and for the consequences of using it.
• We own the rights in the site, the console, our software and the Kervan brand.

9. Suspension and termination

• You can close your account at any time. Your unused purchased balance is refunded under the Refund and Withdrawal Policy.
• If you breach these terms, or in case of suspected fraud, sanctions risk or a legal requirement, we may suspend your account or API keys without prior notice, and close the account for serious or repeated breaches. In that case your unused purchased balance is refunded, to the extent the law and section 4 allow.

10. Limitation of liability

• The Service is provided as the model providers make it available. We do not guarantee that it fits a particular purpose or runs without interruption.
• Except for intent and gross negligence, and without affecting your rights under consumer law, we are not liable for indirect loss or loss of profit. For business customers, our total liability is limited to the amount paid to us in the 12 months before the event that caused the loss.
• Nothing in these terms limits your rights under Consumer Protection Law No. 6502.

11. Changes

We may update these terms. We will tell you about material changes by email or on the site at least [30] days before they take effect. If you keep using the Service after the change, you accept the new terms; if you don't, you can close your account and ask for a refund of your unused purchased balance.

12. Governing law and disputes

These terms are governed by Turkish law. Consumers can apply to the Consumer Arbitration Committee where they live or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Court above those limits. For business customers, the courts and enforcement offices of [Istanbul] have jurisdiction.
