Distance Sales Agreement

1. Parties

BUYER: the person who creates an account on kervan.com.tr and places a top-up order. The buyer's details are those recorded in their account and invoice details.

2. Subject

Under Consumer Protection Law No. 6502 and the Distance Contracts Regulation, this agreement sets out the rights and obligations of the parties for prepaid balance that the BUYER buys online for use in the Kervan Service.

3. Main features of the service

• Purchased balance is held in US dollars and is used to pay for requests sent to AI models through the API at api-kervan.poly1.fun.
• The price of each request is calculated from the model prices on the pricing page and the request's token counts. Failed requests are not billed.
• Purchased balance does not expire.

4. Price and payment

• The order amount is set in Turkish lira, and 20% VAT (KDV) is added. The total including VAT, the balance to be credited (in US dollars) and any bonus are shown before you confirm the order.
• The lira amount is converted to US dollars at the TCMB USD selling rate when the order is created; that rate is locked for the order.
• Payment is made by bank transfer (havale/EFT) from an account in the BUYER's name, with the reference code shown on the order screen in the description. An order not paid within the time shown on the order screen and in the email is cancelled automatically. This agreement will be updated when card payments are introduced.
• The SELLER charges no separate fee for top-ups. Any transfer fee charged by the sending bank is paid by the BUYER.

5. Performance and delivery

The service is performed online; there is no physical delivery. The balance is credited to the BUYER's account once the payment reaches the SELLER's account and is matched to the order, and the BUYER is notified by email. The invoice is sent to the BUYER's email address.

6. Right of withdrawal

• The BUYER may withdraw from this agreement within 14 days of its conclusion, without giving a reason and without paying a penalty.
• Under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly online, and under Article 15(1)(h) it does not apply to services whose performance started with the consumer's consent before the withdrawal period ended. By starting to use purchased balance, the BUYER consents to performance during the withdrawal period and accepts losing the right of withdrawal for the part used.
• Unused purchased balance, however, is always refundable under the Refund and Withdrawal Policy, with no limit to the withdrawal period. Trial credit and bonuses are not part of the purchased service and are not refundable.
• Notice of withdrawal can be given through the refund request screen in the console, by email to destek@kervan.com.tr or to the KEP address [firma@hs01.kep.tr]. The SELLER pays the refund to the account the payment came from within 14 days of receiving the notice, at no cost to the BUYER.

7. Pre-contract information and consent

The BUYER confirms that before confirming the order they were informed of the SELLER's identity and contact details, the main features of the service, the total price including VAT, payment and performance details, and the right of withdrawal and its exceptions, and that they accepted this agreement online. The SELLER keeps the agreement and order details and sends them to the BUYER on a durable medium on request.

8. Complaints and disputes

You can send complaints to destek@kervan.com.tr. The BUYER can apply to the Consumer Arbitration Committee within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Court above those limits.

9. Entry into force

This agreement is concluded when the BUYER confirms the order online. The Turkish text of this agreement governs.
